a) These Terms refer to the Customer in the second person (“you”, “your” etc) and we refer to ourselves Eurocave Importers Ltd trading as EuroCave UK in the first person (“we”, “us”, “our”, etc). Our contact details are on are set out on the Contact Us page of the site.. You may contact us by post, e-mail and fax.
b) These Terms govern all products we sell except those carrying the trade mark or name “EuroCave” or “Artevino”.
c) We may pass your order for specific goods to another supplier, whereupon your contract will be with that supplier.
d) We accept orders only under our Terms of Business current and displayed on our website at the time of your order. Only a director of ours may vary our Terms and Conditions.
e) An order is accepted and a contract exists between you and us when we despatch the items (or the first of them, if we make more than one delivery of a multiple item order) you ordered. We reserve the right to refuse an order until that time.
f) An item is "despatched" at the moment it leaves our shop or warehouse even though it may be with an agent for delivery.
g) Manufacturer's specifications of goods offered by us are subject to change without notice.
2. MAKING A PURCHASE
a) You must provide your credit/debit card details in full when you order. Payment will be taken from your card when the goods are ready to despatch.
b) Goods are offered subject to availability and only at prices displayed on our website current at the time of order. Prices are shown inclusive of Value Added Tax at UK standard rate which will be charged on all orders delivered within the UK and the EC.
c) We accept payment by MasterCard, Visa, Switch, Maestro and PayPal.
a) We may make a surcharge for a UK delivery off UK mainland. We do not deliver outside the UK. We only deliver the following products outside of London. All Zalto products, other selected glassware, the wine suitcase, cloths, driers, funnels and badges.
b) All goods are delivered by parcel delivery service or, in the case of small packages, by recorded delivery post and will usually be made within 1 to 7 days. All deliveries require a signature as confirmation of receipt. We do not guarantee any particular date or time for delivery.
c) You must be responsible for the internal working of the place to which you ask us to deliver the goods to ensure that your purchase reaches you from the point of delivery. If you ask us to deliver to your work address or other commercial premises, your purchase may be left with goods in, the post room or the reception area where the delivery agent will obtain a signature for your order.
d) We insure goods we despatch to you until they are delivered or collected or, (if we cannot deliver goods at the first attempt) until we make that first attempt, but after that time the goods will be at your risk, whether or not ownership has passed.
e) Deliveries are made Monday to Friday (public holidays excepted) between 7.00 am and 5.00 pm.
f) We are not liable for loss damage or shortcomings unless we receive written details within 14 days of the delivery of the item.
g) We are not liable for any claim for loss damage or shortcomings that should be apparent at delivery if you have acknowledged receipt without qualification about that loss damage or shortcoming.
h) We are not in any circumstances liable for any consequential loss or damage arising from any delay in delivery or in any failure to deliver.
i) Deliveries are charged as follows
Up to £19.99 - £2.50
Up to £74.99 - £4.95
Free over £75
4. BACK ORDERS
If your item is not in stock (and we will tell you that when we confirm your order), we will make it the subject of an order for you from the factory or our supplier. We will be unable to give you an estimated delivery date until the factory or supplier has given us an anticipated shipping date. We will not charge for something that is not in stock.
5. CREDIT CARD SECURITY
All online purchases you make from our store are secure. Our site uses 128-bit Secure Socket Layers (SSL) which we believe is the strongest commercially available level of encryption. All credit card information is transmitted directly in encrypted format to the payment processor. We retain none of this. This ensures that your transactions are secure and your information cannot be intercepted by anyone.
6. GUARANTEE AND RETURNS
a) If you are unhappy with your purchase, because the item you have ordered is faulty or defective you must return it to us unused and in its original condition within 28 days of receipt for a prompt replacement or exchange. Full details of procedure are found by following the Customer Services link on our Home Page
b) If you are reporting faulty goods after 28 days of receipt, then provided your product is within its warranty period, you are entitled to a warranty repair. In some cases, manufacturers provide a special full on-site service and or telephone help facilities for your convenience, which of course, we recommend you utilise in order to correct the fault quickly. This does not affect your rights to claim against us under the Sale of Goods Act (as amended) if the goods do not conform to the contract and the manufacturer does not repair or replace the goods or offer you an alternative remedy.
a) If you are a consumer (non-business) buyer and you placed your order without ever visiting our showroom, seeing us at an exhibition or having other direct personal contact with us, and your order does not include any special option item, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you a right to cancel this contract up to the end of the 14th working day after the day of delivery.
b) To exercise the right to cancel you must inform us in writing within that time limit. We will then arrange with you to for the return of the item. In the meantime you must take reasonable care of the item and not use it. The item must be in stock re-saleable condition in the original packaging. We will refund the money you have paid after deducting the cost of original delivery and of collection and return to our warehouse. If we refuse the item we will return it to you at your cost.
c) Otherwise, we reserve all our rights in law in respect of buyers who cancel or repudiate their contract including our right to retain a deposit.
a) Without affecting any other provisions of these Terms of Business we will in no event be under any greater liability to you than the cost to you of the item you have bought and we shall not be obliged to discharge that liability until the item in question has been returned to us.
b) We will not be under any responsibility or liability for any consequential loss or damage that may arise out of the goods supplied by us, the use of those goods and/or any defects in them
9. PRIVACY and RECORD KEEPING
10. COMPLAINTS AND GENERAL
a) Nothing in these Terms and Conditions affects your rights under statute law.
b) No third party shall be allowed to enforce any rights under this contract. You and we
hereby exclude the application of the Contracts (Rights of Third Parties) Act 1999 to the contract made under these Conditions.
c) The proper law of this agreement is English law and disputes will be arbitrated in England.
